Basically the only way around this is that in most applications there 
is a place that says "work references" and then a spot for "personal 
references"  depending on which space your asking for you can do the 
following.  if it is work related then you can say yes or no he/she 
did or did not work for us.  and then you can indicate the exact 
dates.  thats it.  on the other hand if you are giving a personal 
reference then you can get more involved in the question / answer 
part.  if a prospective employer asks if this person is a good worker 
you can say yes/no if asked you can say I would/would not hire them 
etc.  but in order to get the personal reference it has to be called 
at a persons home or personal cell phone not on a work related 
phone.
