Carol responds:
Just a small point here. Of course, it requires permission to post
material from the Lexicon to your own website, but we're protected by
the Fair Use doctrine in our discussions on this website and HPfGu.
IOW, we can quote from the Lexicon if we cite the source and include
commentary, whether we're analyzing the Lexicon itself or using the
Lexicon to support our points about the HP books (in which case it
would be what's called a "secondary source".)
The online Lexicon, like the HP books, is a copyrighted work and for
the purposes of copyright law has been "published" (made available to
the public). So Steve V. has no more and no less protection than JKR.
As for the unpublished print Lexicon, which is now on the Internet,
the rules are a bit less clear, but since I quoted only a small
portion for the purpose of showing that it did not copy and paste FB,
I'm pretty sure that falls under fair use.
Carol, ready to cite the Fair Use Doctrine in the unlikely event that
Steve V. objects to my posts defending his Lexicon
