Malfoy courted, became engaged, and married Narcissa, conceived and "saw" (literally or not) the birth of his son Draco, all during the period when Voldemort was still active, so Lucius was still a Death Eater. 

It would be a tepid day in Antarctica before any active Death Eater would risk Crucio or Avada Kedavra by having a relationship with a woman who was not a proven pureblood.   And all that is just on TOP of Malfoy's own racism.
