I don't believe the Misuse Dept really spots every bit of magic that happens. I think that it's important for Harry's safety - connected to the 'ancient magic' in some way that he doesn't do magic at home. So the MOM keeps a special watch on the Dursleys' house. Even then, they couldn't tell that it was Dobby's and not Harry's magic. It may even be that Dobby tipped off the MOM deliberately in some way when he levitated the pudding.
