Yes, but Harry still didn't get them back, did he?  Dobby says he 
will only return them if Harry promises not to return to Hogwarts 
that year.  There is no mention of Harry getting the letters back, so 
it is still conceivable that Dobby took them back with him when he 
disapparated, thereby making it possible for Lucius to intercept them.
