Part one I can see from where you are coming. Part 2? I think Draco 
Malfoy has shown too much smugness and awareness to not contribute 
in a real way to acts more terrible than simple annoyances. Look at 
the way he was acting in the woods after the Quidditch match in GoF. 
He seemed highly aware of who and what was going on and relishing 
the moment.
