I always assumed that the dementors were out of Fudge's control.  
After all, at the end of PoA, weren't they going to administer the 
Kiss to Harry?  They certainly weren't given permission to do that.  
Besides, if there were a sure-fire way to control them, Dumbledore 
wouldn't be so concerned about them turning to Voldemort's side (at 
the end of GoF).  However, just because the dementors are out of the 
wizards' control doesn't mean your theory is wrong.  I rather like 
the idea that Fudge had the dementor there as the first step in 
covering up a political scandal.
