Question about Snape

In POA, in the chapter at the Three Broomsticks, Fudge(I think, don't 
have the book with me) mentions about one of Dumbledore's 
spies "tipping him off" about James and Lily. Was this spy Snape?

And I've been wondering for awhile: If Snape was a DE, why didn't he 
get punished for it? Even Dumbledore admitted he was a DE, but turned 
back to the light(GOF, The Pensieve). I don't believe the MoM would 
have let him off just because of Dumbledore? He still was a DE and 
must have done horrible things during the war for Voldemort. Was it 
because he was giving them info about Voldemort's actions that they 
decided to let him off for it?
