If they did do the AK curse, good old Habeas Corpus prevails.  Wormtail in 
perfect health, except he is dead.  Even Fudge couldn't fudge on that.

Of course, the GoF would also suffer, not to mention Snape's perfectly 
paranoid Potter reaction at the end of PoA.
