I don't believe that Draco is one. If you'll remember at the World Cup when the DE's were levitating Muggles in the air and causing havoc, Draco was leaning against a tree watching. The kids walked past him on their way into the forest and if i remember correctly, he told Hermione that she better run because they'd be after her next. If he were a DE, i imagine he'd have been in a cloak burning some tents as well.
