We all know what awaits those who DIDN'T come back to him when summoned: "And here we have six missing Death Eaters... three dead in my service. One, too cowardly to return... he will pay." 
  Nevertheless. I truely think Snape is on Dumbledore's side, nasty and unfair as he may seem to his pupils, I think he's not a Death Eater anymore. Why do I think this?? Well, it's a long theory, but I think Dumbledore is pretty sure because he knows something about Snape that we don't, he tells Harry, "that's something between Prof. Snape and me". And I trust Dumbledore in this point.
