[HPforGrownups] Why Couldn't LV get the prophesy for himself?

I had the same thought, but I think I figured it out.

Harry is at Hogwarts.  He is accounted for.  He cannot apperate.  They can 
track his magic.

Therefore if the orb disappears it can't be Harry, thus it MUST be Voldemort.
