IMO what makes sense is that they were released, but that's only I believe in 
DD when he doesn't trust them. To me, Azkaban has been a way for Voldie to 
keep safe his DE waiting for him, even if I haven't dared post the idea, for 
is opinion entirely based. I don't know when the betrayal was signed, but I 
don't think Lucius will stay long there. Why? Just literary sense, not canon. 
Things are going to darken before the end.
