Me:

I'm not sure if there's a conflict here, but there's a line in PoA (chapter 21, Hermione's Secret, pg. 392 US first edition) that would indicate that Sirius wasn't thrown into Azkaban as soon as he was apprehended on the street (literally, nothing even close to a trial).  Dumbledore actually states that he gives testimony that Sirius was the Potters' secret keeper, so it would seem that there was evidence given at some point (even if Sirius was never allowed to testify himself).
