You'll have to take into consideration that the Founders lived 1000 
years ago, and especially during the Drak Age (500-1500) there were 
wars and quarrels that destroyed evidence of who was who's heir. If 
for example a whole family dies, let's say from grandparents to 
children than the legal heir could become someone that wouldn't even 
know of that. So it is possible that due to missing records noone 
except for Dumbledore and a few others knows about it.
