The wizards do make some of their own laws.  Wasn't Arthur Weasley the 
author of a law into which he put a loophole that allowed him to have the 
enchanted car?  It's probably like the Administrative law of the US -- 
agencies are delegated authority to enact their own regulations (which don't 
quite have the same authority as statutes, which come from the legislature).

It seems to me that the MoM is certainly part of the larger muggle 
government.  Otherwise, the head of the wizard government would have a 
higher title, such as Grand Poobah.
