On my second reading, I wondered about this as well. However, OWL 
tests were not administered by Hogwart's professors. I wonder if 
OWLs are not more like an ACT/SAT score which would not reflect your 
grade from the course. Without Snape present, Harry feels like he 
does well in his Potions OWL. Possibly he will manage a "grade" that 
will qualify him for advanced potions.

I think it would be put Snape in a very difficult position to be 
made DADA teacher, especially an effective one (and Snape wouldn't 
have it any other way) and still maintain his under cover 
activities. Wouldn't DE's consider this a conflict of interest?
