Fred and George have opened their joke shop in Diagon Alley and I 
personally think that they are happy to handle the shop and don`t 
want to take the NEWTs at any point in the near future

As he used it against a death eater and a wanted criminal that 
tortured very famous wizards into insanity I doubt that anybody is 
going to press charges, not even Fudge is that thick.
