I don't think that Fudge is an actual Death Eater, but that Lucius slipped 
him some currency to make sure that no one was on duty that night.

I mean its possible that the Death Eaters cleared the way magically, but I 
don't think they would've bothered with it, not to mention it wouldn't be 
the surest plan. While reading I was expecting Harry and team to trip over a 
body, but since that didn't happen and there were no signs of a struggle...

So PayedOff!Fudge instead of DeathEater!Fudge. This would also explain his 
rather unconvincing reaction. He's thinking, 'Crap, I'm *so* caught!' at 
that moment.
