But, remember, Hermione turned it back in at the end of PoA, saying 
it was drove her mad.  I don't think she could have gotten it back 
from McGonagall, not when she (McGonagall) had written all sorts of 
letters saying Hermione wouldn't use it for anything other than 
classes.
