No,I don't believe Hagrid is cleared to use majic. His wand was
broken in half by the MoM - Just like if Harry would have been found
guilty at his trial. He also would have been restricted from using
wand majic. There are other forms of majic one can use for example
out of sheer rage when Harry made the glass dissapear at the reptile
house in PS/SS. They can't take your majical abilities away, but
they can and do prohibit wand majic. House elves are not supposed to
do wand majic, but Winky in Gof was accused of this. In the same
passage they spoke of non-wizard/part-humans not being allowed to
carry or use wands. And don't forget in GoF, Rita Skeeter let out of
the bag that Hagrid was a part giant. That, in and of itself, would
restrict him from using wand majic.
There is also the registering of witches and wizards in particular
areas. When Dd said there was a witness to the dementors, Umbridge
said there were no other wizards registered in Surry, even though
Figg (who is a sqib) lives there. This leads me to believe that
they keep a close watch on areas where they do not know of any
witches residing. Majic being performed in a non-wizarding area
would definately raise red flags. Especially since Fudge was already
thinking that Dd was raising an army against him, and now there is
majic being used in Giant country.
What I want to know is: 1.)Hagrid's wand was broken. 2.)It is highly
suspected that he was able to repair it and stow it away in his
umbrella. 3.)Uses it with relative ease and lack of training. Then
why then couldn't Ron do the same with his wand in CoS?
