I thought this was a good point, but I also wanted to point out that the MoM doesn't seem to nail underage magic users. Harry letting the snake free, Harry turning his teacher's wig blue, ect. The MoM doesn't seem to start keeping track of underage magic users until they start at a wizarding school. Someone must, though, in order to figure out who to accept in school - perhaps Hogwarts.
