Lissa replied:
You're right, of course.  I'm sure Tom would be found guilty of Myrtle's 
murder in any reasonable court of law.  It was, however, actually the 
basilisk that killed the girl.  I'm not sure it's clear that Tom sicced 
the creature on Myrtle or whether she was just in the wrong place at the 
wrong time.  The latter (and even the former) is a bit different from 
deliberately choosing three specific victims and murdering them 
personally, but I do acknowledge what you're saying. It's also possible 
Tom killed people with his own hands/wand prior to the Riddles, but that 
evidence of it has not yet appeared in the series.
