Because we know that the cut-off date is no later than mid-October.  
Angelina turned 17 in mid-October of her sixth year.

That would mean that at the very most a student can be 2 1/2 months 
younger than Harry and be in his year.  Thus a student could be 9 
1/2 months older and be in his year.

Harry may not be one og the very youngest, but he's on the younger 
end.
