The Ministry of Magic was empty when Harry and company showed up 
there. Where was everybody. Had they all gone home for the evening?

Me -

Well most of the officials and stuff would have gone home I expect and
security would have been there normally but I imagine the DEs got rid of
them. I mean it wasn't much of a plan to start off with frankly, luring
Harry to the Ministry, but it would be very embarassing to have to admit to
Voldemort that his plan failed because you didn't get rid of the guards and
Harry and co were detained before they even got to the Dept of Mysteries.
Voldemort after all really didn't want to visit the Ministry personally and
prove that he was back so Harry had to get the prophecy and for that he
needed to be able to get to the right room.
