And one more thing, how come you can use a portkey at Hogwarts (GoF & 
OoP)?  Doesn't this defeat the purpose of the protection against 
apparating?

I don't believe that using Fawkes was anything like apparating, in CoS Harry and gang use Fawkes to get back up the pipe. Fawkes is a pheonix and one of his attribute is great streangth. How can thay have used a portkey? Well just a thought on this, DD is Headmaster of HW, I think that he might be entitled to "bend" the rules when needed. As for why he flew in PS/SS - he did have many options open to him for traveling to the MoM (fawkes, floo-powder, portkeys...)I think he flew just because he wanted to, it sounded nice, and for no other reason.
Just some thoughts...
