Sirius - who is right?

But Sirius had given Harry the mirror, and Harry never used it.

yes, Sirius gave Harry the mirror and Harry never used it; a fact 
that frustrates me to no end. {The USS SAD DENIAL is the finest ship 
ever!} However, in context, it is understandable.  Harry knew that 
Sirius was in as much (if not more) danger as Harry.  And it wasn't 
given with the comment "Take this and we can talk safely".  No!  It 
was secretly delivered with the comment "I want you to use it if you 
need me"  Anyway, the mirror was Sirius' idea (and a thumpin' good 
one at that), but he had to hide it from Molly and the others.  
Why?  The point above was that it would have made things better for 
both Sirius and Harry if Dumbledore had enabled them to communicate 
safely/regularly.  And, I agree that it probably would have helped 
both.
