Well Hagrid wasn't about to disobey orders from DD, so we can forget
about Sirius getting Harry at that instant. As for after DD gets
Harry from Hagrid, I would imagine DD gets off not giving Harry to
Sirius because at that time he was the betrayer of Harry's parents
and depending on the exact timeline he may have been the murderer
that he went to Azkaban for being. DD didn't know that the Secret
Keeper had been changed from Sirius to Peter.
If DD hadn't stepped in and Sirius took Harry who knows what might
have happened because I would imagine that the Order would put
together a massive manhunt for the person who was responsible for
the betrayal of the Potters and the kidnapping of Harry. And who
knows what might have happened to Sirius if the Order or Aurors
caught up with him.
