Prefects and Points

I am a bit confused about the Prefects and their relationship to the 
point system.  In CoS, Percy, as a Prefect, takes 5 points from 
Gryffindor when he 
catches Ron coming out of the girl's bathroom (US pg 158).

In OOP, Draco, Ernie, Hermione, Ron, and Harry all admit that 
Prefects can't deduct points, only teachers can. (US pg 625-626).

I can't come up with explanation for this.  Does anyone know 
something I missed?
