I was discussing this very thing with a friend last night, and she pointed
out something I had forgotten.  In CoS, Hagrid is sent to Azkaban on
suspicion that he opened the Chamber again.  It was supposed to be a
temporary measure.  We never got the impression from that book that it would
be permanent without a trial or hearing or something.  Maybe this is what
they did with this batch of DE's.  They are arrested and sent to prison
pending trial.  We don't know for sure, haven't heard one way or the other.
