FWIW, I am not *terribly* concerned about HP having used an 
Unforgivable Curse. This is for a number of reasons:

1- It was done in "the heat of the moment" and not with any sort of 
malicious PREmeditation. It was done, IMO, more to express (however 
inarticulately) HP's rage of the moment.

2- This is war. Whether we care to admit it, the war began when 
Voldemort returned. If the prophecy is to be relied upon--and I am 
of a mind it is--then HP is going to have to use another 
Unforgiveable Curse (AK) on Voldemort. Is anyone expressing concern 
over that?

3- The curse HP used on Bellatrix wasn't a proper curse, that is, it 
didn't have the effect this curse is normally intended to have, in 
fact, it merely "stunned" her momentarily. Is the curse unforgivable 
because of what it actually manages (or fails) to do...or because of 
the intent the user has...or simply because it is used? In either of 
the 1st two counts, HP gets off the hook of unforgiveability.
