  I think that,given the circumstances, Harry's use of the Cruciatus 
  curse is not going to be punished, nor is it out of character. Bella 
  had just killed Sirius, and Harry was trying to avenge that death. 
  Sirius was the nearest thing to a parent Harry had known, and she had 
  stolen that from him. (*sob*) 
  With all the fighting going on in the DoM, it's unlikely that Harry 
  would be punished, especially since he was fighting a DE. 
  I'm glad it didn't work though, it shows that Harry is still learning 
  and that even in his hatred, he is not evil enough to be like a DE.

  I found it very disturbing that Harry acually used the Cruciatus curse. He will probably get away with it because the only one who witnessed it, was Bellatrix herself and who would believe her? 

  I don't think that it was out of character either. Already in POA I remember the scene when Harry still thought Sirius had killed his parents and he stood before him defenceless. Then I remember Harry thinking that he wanted a wand right now, not to defend himself but to attack...to kill. There was a second instance in GOF, where Harry was angry enough to be able to kill. In OOTP he has been boiling with rage underneath all the time. I think it was just natural for him to let it out on a woman who had just killed the only man who could ever have given Harry a home and a family where he would have felt loved and accepted.
