The main problem with Malfoy as Head Boy is that he
would abuse his 
power, just as he did while he was a prefect and on
the Inquisitional 
Squad.

So I can't see Dumbledore ever appointing him;  in
fact, I'm 
astonsihed he even became a prefect.

 I think I finally figured this one out. Each house
gets 2 prefects one male and one female from every 5th
year class. So DD has no option but to pick a Slyth
male prefect. Out of the choices in Draco's group he
appears the best choice of a slimy lot. Also it seems
from the way things fleshed out that prefects could
only take points from their own house. If so he really
wasn't a danger to the others until he was elevated to
the Hitler Youth..........  uh I mean the
Inquisitorial Squad.
