Correct me if I am wrong, but isn't good ole' Lucius already at 
Azkaban?  At the end of OOTP, Harry and Draco have a confrontation 
and Harry says he's already gotten Lucius in prison, and Draco says 
he wont' stay in there long, not without the Dementors guarding it?

I don't have my book, so I may be recalling things incorrectly.
