Well, remember, DD wasn't headmaster anymore at the time, he was on 
the run from Fudge. Umbridge would be the one nominally responsible 
for the children.  Still, your point about a good lawyer getting 
Malfoy off the hook is well taken.  But do they even have lawyers in 
the WW?  Harry certainly could have used one at times.
