No, not the fact that he cannot cast crucio justifies the fact that 
he tried. The fact that he just witnessed his Godfather pushed 
through the Veil by the madwoman does, IMO.

If he wanted to kill Bella (I hope somebody does, preferably Nevill), 
he as other posters pointed out would have cast Avada. He did not do 
it. He wanted to hurt her badly. I am not surprised at all.

Justice system actually does care whether you were provoked or not. 
Take it from someone who is involved in it. :o)
