The only thing we know is that Crouch was thought at one time to be
the front-runner but that Fudge got it instead because Crouch was
viewed as callous towards his son. It sure sounded like a back-room
deal. This might seem like a parliamentary system reminiscent of
Regency Britain where the Ministry pretty much named the leaders and
the electors went along, except for broad trends. IOW, the head of
the most popular faction gets the job.

You are predicting that Lucius will break out of Azkdaban and take
over the Ministry in some sort of coup de main? That wouldn't be a
coup, it'd be open combat. I don't think that's likely. Neither
Fudge nor Mafoy has any credibility in the wizard world. If Malfoy
was to seize the Ministry, government would just move to Hogwarts.
