Potioncat:
I think JKR used the word inherit as in "passed down."  Sometimes 
parents pass down family heirlooms to their children while the 
children can use them, or after the parent doesn't really have a 
need for the heirloom.

Perhaps the Potters are a long line of rule breakers and it is 
family tradition to give the son the IC while at school.
