Derek:
The simplest answer would be to speculate that not literally *everything*
is killed when it looks at the basilisk's eyes.  Phoenixes' relationship
to life and death are different than other creatures.  Perhaps something
about them renders them immune to the basilisk's effect.  (Or perhaps
Fawkes, being a smart bird, knows of the basilisk's power, and closes his
eyes when striking at the basilisk.)
