Oh, I think he probably is smart.  The impression I got from that scene is 
not that Draco is getting bad grades, but that Lucius is furious because 
Draco (along with the rest of the students) isn't getting better grades than 
Hermione, and thinks he should be outperforming a Mudblood on principle.  
Draco's excuse about teachers having favorites may be just that, an excuse, 
or he may actually believe it, on the theory that otherwise of *course* he'd 
get better grades than any Mudblood ...
