I say:

What you are missing is that Fudge doesn't care about trials and acts 
unilaterally. Think of Crouch being given to the Dementors at the end of POA. And he 
sent Sirius to Azakaban without a trial. That the rest of the MOM went along 
with this is one of the places where I simply have to accept what JKR has 
written. 

Laws and rules in the WW seems to be enforced very arbitrarily. One of the 
few problems that I have with the WW has to do with the foolishness or 
immaturity of "adults."  With exceptions, I don't have a lot of respect for adult 
wizards.
