Malfoy was never charged with anything because there was really no 
evidence, except the blank diary, and that isn't enough to link him 
to the book or an kind of plot. DD seems to have his suspicions 
about Malfoy, as evidenced by his words of advice to Malfoy 
(something about it being a bad idea to start passing out Tom 
Riddle's old school things to innocent people). The Weasley's 
probably don't know, though I am sure that Arthur could figure it 
out. As for who else knew, Dobby, did, didn't he? He was the one who 
came to warn Harry that terrible things were afoot.
