Murder is "The unlawful killing of one human by another, especially
with premeditated malice."

Killing Voldemort cannot be murder no matter how Harry does it.  If
Harry could kill Voldemort with an AK, it would be the only right
thing to do to save lives.  

But I agree that's not what will happen.  Voldemort hasn't been
naturally alive in a long time. If the magic left him, so would his
existence; that, and the link to Harry Potter, will be his downfall,
probably to Harry's great cost.
