Eloise commented in her mail about the ton Tongue Toffee incident and the fact that it *was* a piece of underage magic performed on a Muggle in a house which seems closely monitored.

No spell was done in the Dursley house to create the Ton Tongue Toffee; that had probably been done at the burrow. and Dudley eating it wasn't a spell, although it may have activated a new spell.
In addition, Arther Weasley, an adult wizard was present. Maybe the MOM can't pinpoint the spells, but can check who was in the right place at the right time to do them. If Harry was the only wizard, then he must have done it; however, if Arther Weasley was there, the ministry can't know who it was.
