Joana  and all:
 I think I finally found the answer to this question of  strange even lopp
sided underage magic enforcement.
I was listenening to one the Jim Dale Audio Books when it hit me  The
M.O.M.'s job is to make sure the muggles don't find out about witches and
wizards existing.

 Now Harry is clearly the only wizard child in his area. He lives with
muggles, just as Tom Riddle did. I am sure the M.O.M. kept an equal eye on
Tom who was living in a muggle orphanage. Anyone wonder how the MOM got the
orphanage to allow Tom to go to a wizards school? I am sure some kind of
mind jinks was used on them.  Now, I am sure that in places like the Burrow,
which is clearly hidden from most muggles, the MOM does not keep as close an
eye on the children, as they would with someone like Harry or Tom. Why would
they have to? Aren't wizard adults fully aware of what could happen if their
children expose the wizard world to muggles? And the adults would be held
accountable.

But who would be held accountable in Harrys case? Look at what hes done so
far. The Muggles are directly responsible for pushing Harry past his limit,
and have caused him to loose his temper at least twice - once to Marge by
blowing her up, and the second time during the beginning of book 5 when
Harry was laying outside the window, listening to the news. Vernons hands
had grabbed Harry around his neck, and he let go when Harry had a sudden
surge of power, that appeard to have electrocuted Vernon.  Both times, the
muggels were responsible for it.  The only time they directly held Harry
responsible was when he knowingly and intentionaly used his WAND to do magic
within the "muggle zone" so to say.

And that is why I think that the Restriction on underaged magic, has more to
do with the "muggle zone" than just doing magic in front of your wizarding
parents in their "Wizard zone".
