This is after the stuggle.  After Lily insists they stop.  We are 
not told whether Severus has his wand.  We are not told if Sirius 
has a wand pointed at him.  We are not told the wand is on the 
ground.  We just don't know.  So maybe he is under "restraint" and 
has no choice, or maybe  he does.  I'll agree that I don't know if 
he is playing fair here, but I state it is a possibility.
