Good theory.  That would also support that the reason Snape has been 
turned down for the DADA job was to keep up appearances -- that DD 
doesn't trust him enough to allow him to teach that class.  However, 
Voldemort's power in legilimency/occlumency is not absolute.    I 
believe Snape could prevent him from reading his thoughts -- 
otherwise, LV would know about all the work that Snape does for the 
Order.
