There may indeed have been an ex post facto "hearing" - or at least witness  
interviews - to justify throwing Black into Azkaban.  ("See, I was right -  it 
couldn't have been anyone else!")
 
The Ministry was still working on a war footing - and things are winked at  
in war that wouldn't be tolerated in peacetime.  (Andersonville,  Elmira...)  
I'm NOT saying that's a good thing (not 'ardly!) - just stating  that it 
happens.
