Yes Harry had the Marauder's map in OOTP.  He used it after one of the DA 
meeting to make sure that the halls were clear so that the student could get back 
to their dorms.  He also used it when he, Hermione and Ron snuck down to 
visit Hagrid right after he had   arrived back at the school from visiting giants.

And you are correct there was no mention made of him actually getting it 
back.  JKR said in an interview that she knew she should have written a scene of 
him swiping it back from fake!Moody's office.
