I suspect this a Flint (did JKR forget about apparating in/out of Hogwarts?)
or 
Draco's lying to cover up the significance of the cabinet. 
or
the rumors about Montague ending up in a toilet are exaggerated
or 
apparating inside a "moving" object has wacky results...I highly doubt Montague was 
focused on a toilet in Hogwarts :)
